Booking Terms & Conditions

Effective 1 August 2026

These Booking Terms & Conditions include the Cancellation, Modification & Refund Policy for Surfside Bali and are issued by PT SURFSIDE DEVELOPMENT GROUP.

1. Introduction

These Booking Terms & Conditions ("Terms") govern direct bookings of accommodation at Surfside Bali, made through the official website https://surfsidebali.com/ or other official direct-booking channels operated by PT SURFSIDE DEVELOPMENT GROUP ("Surfside," "the Company," "we," "us," or "our"). These Terms form the contract between Surfside and the guest, or the person making the booking, in relation to the reservation described in the applicable booking confirmation.

Section 8 of these Terms sets out the Cancellation, Modification & Refund Policy applicable to direct bookings.

If your booking was made through Booking.com, Airbnb, Agoda, Expedia, or another third-party booking platform or travel agent ("OTA"), additional or different terms of that platform may apply to your booking, as described in Section 21. These Terms govern direct bookings; where a booking is made through an OTA, you should also refer to that OTA's own terms and cancellation policy.

2. Contracting Party and Scope of Application

These Terms apply to any person who submits a direct booking through the Website ("guest," "you"), including a person who books accommodation on behalf of other guests. If you book on behalf of other guests, you confirm that you are authorized to accept these Terms on their behalf and to share their personal data with us as described in Section 22.

These Terms do not apply to bookings made through an OTA, which are instead governed primarily by that OTA's own terms, in addition to the operational rules for the property described in these Terms (see Section 21).

3. Making a Booking; Rates, Taxes and Total Price

Before you confirm a direct booking, the Website will display the accommodation type, stay dates, the applicable rate, and the total price.

The total price displayed includes applicable government tax and service charge, consistent with standard practice for accommodation rates published by hotels and villas in Indonesia. If any additional mandatory charge applies to your booking, it will be clearly disclosed to you before you confirm payment.

Rates may vary depending on the dates selected, occupancy, length of stay, and applicable promotions. Some rates are non-refundable or carry other specific conditions, as described in Section 8.7 (Non-Refundable and Promotional Rates).

We aim to display accurate rates and availability. However, prices and availability may change until your booking is confirmed. If a pricing or availability error is identified before your booking is confirmed, we will inform you before proceeding.

4. Payment and Payment Processing

Payments for direct bookings made through the Website are processed by Xendit, our third-party payment gateway provider.

Payments are made using the payment methods available through Xendit at checkout, which typically include major payment cards, bank transfer, and other locally supported payment methods, in the currency displayed during booking. Depending on the rate and dates selected, full payment or a partial prepayment may be collected at the time of booking, with any remaining balance due before or at check-in, as indicated to you during the booking process.

Payment-processing fees, bank charges, and currency-conversion differences that may apply to your payment or to any refund are described in Section 8.6 (Refunds).

We do not store your full payment card details. These are processed directly by Xendit in accordance with its own applicable terms and security standards.

5. Booking Confirmation and Contract Formation

To make a direct booking, you generally: select your accommodation and rate; review the total price and applicable conditions, including the cancellation terms applicable to your selected rate; accept these Terms; and submit your booking and payment details.

A booking is treated as confirmed, and a contract on these Terms comes into effect, once the applicable payment (in full or as a prepayment, depending on the rate) has been successfully processed and Surfside has issued a booking confirmation to you. The booking confirmation will state your booking details and the cancellation/modification conditions applicable to your reservation.

6. Guest Responsibility for Booking Information

You are responsible for ensuring that the information you provide when making a booking — including guest names, contact details, dates, and number of guests — is accurate and complete. Surfside is not responsible for consequences arising from incorrect or incomplete information you provide, including a booking confirmation sent to an incorrect email address.

7. Changes Requested by the Guest

Requests to change your stay dates are subject to availability and to the rates applicable to the new dates.

If we are unable to approve your requested change and you do not wish to proceed with your original reservation, the cancellation fee applicable to your original reservation, as described in Section 8, will apply.

If the new dates cost more than your original reservation, you will be required to pay the difference. If the new rate is lower than your original reservation, the difference will not be refunded.

8. Cancellation, Modification & Refund Policy

8.1 General Principle

All cancellations of a direct booking are subject to a cancellation fee, calculated as described in this Section 8. The specific cancellation and payment conditions applicable to your rate will also be shown to you during the booking process and stated in your booking confirmation. Where those specific conditions differ from the general rules below, the conditions shown to you before booking and stated in your confirmation apply to your reservation, as described in Section 8.8.

8.2 and 8.3 Cancellation Fees by Length of Stay

The cancellation fee for a direct booking depends on the length of stay and how far in advance the cancellation is received, as summarized below. All deadlines are calculated according to local time in Bali, Indonesia, at the property.

8.4 No-Show

If you do not arrive on your confirmed check-in date and do not inform Surfside in advance, your reservation is treated as a no-show. In this case, the full reservation amount will be charged, and Surfside may release the accommodation for resale.

8.5 Booking Modifications

The terms applicable to requests to change your stay dates are set out in Section 7 (Changes Requested by the Guest).

8.6 Early Departure

Once you have checked in, your reservation becomes non-refundable. If you check out before your confirmed departure date, all remaining unused nights will be charged in full.

8.7 Refunds

Any refundable balance will be returned to your original payment method. Payment-processing fees, bank charges, and currency-conversion differences applicable to your payment or refund are non-refundable.

Refunds are generally processed within 14 business days of approval. The time needed for the funds to reach you also depends on your bank or payment provider and is outside our control.

8.8 Non-Refundable and Promotional Rates

Non-refundable rates, promotional offers, group reservations, long-stay rates, and peak-season bookings may carry stricter cancellation, modification, or payment conditions than the general rules in this Section 8. The specific conditions applicable to your rate will be displayed to you during the booking process and stated in your booking confirmation, and those specific conditions apply to your reservation. Conditions that were not disclosed to you before you completed your booking will not be applied to your reservation retroactively.

8.9 How to Submit a Cancellation or Modification Request

Cancellation and modification requests must be submitted in writing, using one of Surfside's official communication channels: our official email (sys@surfsidebali.com), WhatsApp (+62 811 30 99 11 17), or the communication channel used for your direct booking. A request is treated as received on the date and time (Bali local time) it is actually received by Surfside through one of these channels.

9. Changes or Cancellations by Surfside

If Surfside is unable to provide your confirmed accommodation for reasons within its control, we will contact you as soon as reasonably possible and, where reasonably possible, offer comparable alternative accommodation. Where no reasonable alternative is available, we will provide a full refund of amounts paid for the affected booking.

This Section does not limit any right you may have under applicable Indonesian consumer protection law.

10. Check-In, Check-Out and Guest Identification

Unless otherwise stated during booking or in your booking confirmation, standard check-in time is from 3:00 PM and standard check-out time is until 11:00 AM, local Bali time. Early check-in and late check-out may be available on request, subject to availability, and may be subject to an additional charge.

Guests are required to present valid identification (such as a passport or other government-issued identification) at check-in, consistent with applicable Indonesian accommodation regulations, and may be asked to complete a standard guest registration form, consistent with common practice at Indonesian hotels.

11. Children and Minors

Bookings must be made by an adult capable of entering into a binding contract. Children of any age may stay at the property when accompanied by an adult guest included in the booking. Additional charges may apply for extra beds, cots, or occupancy beyond the standard number of guests for the accommodation type, as displayed during booking.

The maximum occupancy for each accommodation type, and any charge for guests beyond the standard occupancy, will be displayed during booking and/or stated in your booking confirmation.

13. Guest Conduct and Property Rules

Guests are expected to behave responsibly and to respect other guests, staff, and the property during their stay. Detailed property or house rules (for example, regarding noise, shared areas, and other on-site conduct) may be published separately as Hotel Policies and will apply in addition to this Section once available.

Surfside may take reasonable action, consistent with applicable law, in response to conduct that endangers other guests, staff, or the property.

14. Damage to Property

Guests are responsible for damage to the accommodation or property caused by them or their visitors, beyond normal wear and tear.

15. Smoking, Pets and Events

Smoking is not permitted inside guest accommodations but may be permitted in designated outdoor areas. Pets are not permitted unless otherwise agreed with Surfside in advance. Private events or gatherings at the property require prior approval from Surfside.

16. Guest Property and Personal Belongings

Surfside is not responsible for loss of, or damage to, personal belongings left by guests at the property, except to the extent required by applicable law. Guests are encouraged to take reasonable care of their own belongings.

17. Hotel Facilities, Services and Maintenance

Facilities and services available at Surfside Bali will be described on the Website and/or in your booking confirmation. As Surfside Bali is an actively developing project, certain facilities, amenities, or areas may be temporarily unavailable due to construction, maintenance, or similar reasons. We act reasonably to minimize disruption to guests but do not guarantee uninterrupted availability of every facility at all times.

18. Force Majeure

Neither party will be liable for a failure or delay in performing its obligations under these Terms to the extent that the failure or delay is caused by an event beyond that party's reasonable control, including natural disasters, earthquakes, volcanic activity, severe weather, government restrictions, epidemics or pandemics, interruption of utilities, transport disruption, civil disturbance, or similar events (a "Force Majeure Event").

Where a Force Majeure Event prevents Surfside from providing a confirmed booking, Surfside will contact the guest and offer an appropriate solution in accordance with applicable law and the circumstances, consistent with Section 9. This Section does not exclude any right or remedy that cannot be excluded under applicable Indonesian law.

19. Liability

To the extent permitted by applicable law, Surfside's liability in connection with a booking is limited to losses that are a reasonably foreseeable consequence of our breach of these Terms.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, intentional misconduct, or any other liability that cannot be excluded or limited under applicable Indonesian law.

20. Website and Booking Information Accuracy

We aim to keep the Website, including descriptions, images, rates, and availability, accurate and up to date. However, the Website may occasionally contain errors or become temporarily outdated. Where a material error is identified in connection with your booking, we will inform you and offer a reasonable solution before your booking is treated as final, where reasonably possible.

21. Third-Party Booking Platforms

If your booking was made through an OTA (such as Booking.com, Airbnb, Agoda, or Expedia) rather than directly through the Website, these Terms do not govern your booking. The applicable terms of that OTA apply, in addition to Surfside's operational rules for the property described in these Terms (for example, check-in, conduct, and property rules).

These Terms do not state that Surfside's terms take priority over the mandatory terms of any OTA. Where a conflict exists, you should refer primarily to the terms of the platform through which your booking was made.

22. Personal Data

Surfside processes personal data in connection with bookings — including booking data, identification/passport information where required, payment-related information handled by Xendit, and data relating to children where included in a booking — in accordance with our Privacy and Cookie Policy, available at https://surfsidebali.com/policy. That Policy also describes the use of third-party booking, analytics, and communication tools, and your rights as a data subject.

If your booking was made through an OTA, that platform's own privacy practices also apply to your data as processed by that platform.

23. Complaints

If you have a complaint about your booking or stay, please contact us using the details in Section 27 as soon as reasonably possible, so that we can try to resolve it. We aim to acknowledge complaints promptly and work with you toward a fair resolution, escalating to management where necessary.

24. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising from these Terms that cannot be resolved amicably is subject to the jurisdiction of the competent Indonesian courts having jurisdiction over Surfside's registered address, without prejudice to any right you may have to pursue a claim before the Consumer Dispute Settlement Body (BPSK) or another consumer-protection mechanism available under Indonesian law.

25. Language

These Terms are published in English only. English is the governing language for the interpretation of these Terms.

26. Changes to These Terms

We may update these Terms from time to time. The version of these Terms applicable to your booking is the version in effect, and accepted by you, at the time you completed your booking, as recorded by Surfside.

28. Effective Date

These Terms are effective as of 1 August 2026.
